Trademarks distinguish your product or service from those of others; for example, the Coca Cola trademark distinguishes its beverages from other competing beverages in the marketplace.

A trademark can be one or more words, sounds or designs used to distinguish the goods or services of one person or organization from those of others in the marketplace.

Trademarks are important to a business because, over time, a trademark comes to stand not only for the actual goods and services you sell, but also for your company’s reputation and brand:

  • It represents your business identity and your distinct brand;
  • It differentiates you, your product and your services from those of your competitors.

By registering your trademark, you protect it under law from misuse by others, and you gain exclusive rights to use it throughout Canada for 15 years (a term that you can renew).
